1. WHAT IS THIS PRIVACY POLICY?

This privacy policy (hereinafter – the Privacy policy) defines main rules and conditions of personal data processing that are binding for all visitors of websites controlled by REALCO group companies, the list of which is provided below (hereinafter – REALCO), i.e. www.realco.lt, www.bc-hero.lt, www.algirdo3.lt, www.vileisio27.lt,
https://www.baltupisi.lt, https://just-in.lt,v(hereinafter – the websites), persons who carried out active actions on REALCO social media accounts, persons who agreed to receive REALCO marketing materials, persons participating in REALCO events, candidates participating in job competitions of REALCO (hereinafter – the Clients).

It will be considered that the Client familiarised himself/herself with and expresses his/her consent to observe the Privacy policy when visiting the Website, REALCO social network accounts, agreeing to receive REALCO direct marketing messages, applies for job vacancy in REALCO, visits REALCO events. The Client disagreeing to any provision of the Privacy policy loses the right to visit the Website, apply for job vacancy in REALCO, carry out active actions on REALCO social network accounts.

3. WHAT IS PERSONAL DATA?

Personal data is any information collected by REALCO about the Client, which can be used to identify the Client and is stored in electronic or other format.

Personal data includes any information, including the Client’s name, surname, address, email address, phone number, which REALCO collects about the Client for the purpose specified in this Privacy policy or separate consent or agreement of the Client with REALCO.

This data also includes personal information of the Client available in public space, which becomes known to REALCO when the Client contacts REALCO via social media or carries out active actions on REALCO social media accounts.

4. HOW PERSONAL DATA OF THE CLIENTS IS COLLECTED AND USED BY REALCO

REALCO needs personal data of the Clients which may be collected by the below-described ways. The Privacy policy states what can be expected when REALCO collects personal data about:

  • persons who agree to receive REALCO marketing materials;
  • persons who contacted REALCO;
  • Website visitors;
  • social media users who contact REALCO by any means on REALCO accounts in social media or participate in them by their active actions;
  • persons attending REALCO events;
  • job candidates.

5. DIRECT MARKETING

Direct marketing is carried out exclusively in respect of persons who are 16 or older.

For the purpose of direct marketing, REALCO will process the following personal data: name, surname, phone number, electronic mail address.

Persons who provided their contact details and expressed their wish to receive information about properties and/or services offered by REALCO will receive offers about REALCO services or property acquisition, newsletters and other advertising materials, will be asked their opinion about customer care, acquired property, will receive REALCO news by electronic communication means (email, SMS, etc.).

Your data will be used for direct marketing for the period of one year from the date of consent, and then deleted.

You have the right to stop receiving direct marketing messages by sending us an email to privatumas@realco.lt.

6. CONTACT US

There are several ways to contact REALCO available on the website. All messages are accepted, read and answered by ourselves. If you contact us by email, we will process the following data of yours: Your name, surname, email address and correspondence text. If you contact us by filling in a contact form on the website, we will process the following personal data of yours: name, phone number, email address, message text.

The data will be processed to make preparations for agreement implementation or to answer your questions. If you do not provide your contact details, we will not be able to contact you.

Please note, that email monitoring and blocking software may be used and you must ensure that your sent messages are free of any unlawful content.

Correspondence is stored for 5 years from the day of receipt of a message or for 10 years if you purchase real estate, the developer of which is REALCO, except for the information, which is subject to different storage periods established in the Privacy policy or legal acts.

If you contact us by phone, upon your consent, conversation will be recorded. Conversations are recorded to ensure quality consulting for persons and objective examination of complaints. When conversation is recorded, the following data of yours is saved: phone number you are calling from, phone call record. For the purpose of quality consulting of persons, the information is stored for 30 days, and then deleted. For the purpose of complaint examination, data is stored for 4 years.

All personal data provided by you when communicating with us will be used exclusively for the above-mentioned purposes and message reading and administration and management of communication flows. We undertake an obligation, without your expressive consent, not to use your personal data in any publications in the manner that your identity could be established.

Please note, that we might need to contact you by post, email or phone. If your personal data changes, please inform us without any delay.

7. WEBSITE VISITORS

7.1. COOKIES

Cookie is a small file of letters and digits, which with your consent, is stored in our browser or hard disc of your computer. We use different cookies for different purposes. They help REALCO to improve website operation, e.g. to ensure users easily find what they are searching for. The basis for processing data collected by this type of cookies is Client’s consent.

7.1.3. FUNCTIONAL COOKIES

This type of cookies are used to recognise the Clients when they return to the website. It enables REALCO to provide content adapted to the Client’s needs, to remember information relevant to the Client. The basis for processing data collected by this type of cookies is Client’s consent.

Message settings for marketing serviced by Google can be managed on www.google.com/ads/preferences. 7.2. THIRD PARTIES’ SERVICES

To be able to improve the website, we have to know which information interests our website visitors most, from which cities our website is visited, visitors’ returning frequency, browsers used, devices on which our website is read, etc. This information is collected by using Google Analytics tools which enable recording and analysing statistical data of the website use. 8. SOCIAL MASS MEDIA

All information you provide to us on social media (including messages, use of ‘Like’ and ‘Follow’ fields, and other communications) is controlled by the social network controller.

9. ATTENDING EVENTS ORGANISED BY REALCO

With your consent, the fact of your attendance, name, surname and photograph will be used in public communication about REALCO events. Your photographs taken during REALCO events, with your consent, can be published on REALCO social media accounts, website.

Media representatives can publish your photographs exclusively in accordance with the requirements of the law applicable to them, however REALCO does not assume responsibility for media representatives’ actions.

Photographs will be published and stored for 2 years after the event, with the exception of cases permitted by laws.

10. PARTICIPATION IN JOB COMPETITIONS

We collect and process your curriculum vitae and/or motivational letter and/or other information provided by you during participation in job competition for the purpose of recruitment, on the basis of your consent, which you express to us or recruitment company, by sending your curriculum vitae.

If you fail to provide your CV and/or motivational letter, we will not be able to assess your suitability to job vacancy.

If you do not express your separate consent to your personal data processing after the recruitment, your personal data will be erased and/or destroyed within 5 working days from the day of signing an employment contract with the successful candidate.

11. DATA DISCLOSURE

We can disclose information about you to our employees, managers, agents, service providers or subcontractors, provided it is reasonably needed for the purposes specified in this Privacy policy.

Besides, we can disclose information about you:

  • If we required to do so by law;
  • To defend our rights or interests (including disclosure of your personal data to third parties, including collection of your debts to us);
  • intending to sell a part of business or assets of REALCO, by disclosing your personal data to potential buyer of business or a part of it;
  • upon sale of REALCO business or substantial part of its assets to third parties.
  • to third parties who provide marketing services in online search programs, social networks, etc. Such third parties have their own privacy policies and you may at any time directly object to the processing of your data in accordance with their privacy policies.

Your personal data will not be disclosed to a third country and/or international organisation.

We do not disclose your personal data to any third parties, except the cases stipulated in this Privacy policy.

The list of recipients or categories of recipients specified in the Privacy policy may change, therefore if you want to be informed about any changes in the recipients of your personal data, please inform us by sending an email to privatumas@realco.lt, stating ‘I wish to receive information about any changes in the recipients of my personal data, name, surname’.

12. THIRD PARTY’S MATERIALS AND THIRD PARTY’S WEBSITES

Our website and App may contain third parties’ advertising. Such third parties bear exclusive responsibility for the content of such advertising and must ensure its compliance with all applicable laws and regulatory acts.

Visiting third party’s websites is at your own risk. We do not assume any direct or indirect responsibility for content, accuracy of information, opinion, quality of products and services offered by a third party on its website.

Our information material may contain information, the source of which is third parties’ websites. Material taken from third party’s website will be appropriately marked, besides, a link to the initial website may be provided. We do not assume any responsibility for materials published on third party’s website, the link of which is provided to the Client for further information about an event, or for personal data used by such third party.

13. SECURITY OF YOUR PERSONAL DATA

Your personal data will be processed in accordance with the General Data Protection Regulation, Law on Legal Protection of Personal Data of the Republic of Lithuania and other requirements established by legal acts. When processing your personal data, we implement appropriate organisational and technical measures to protect personal data from accidental or unlawful deletion, modification, disclosure, and from any other unlawful processing.

14. YOUR RIGHTS

This part provides information about your rights related to your personal data processing carried out by us, and cases, when you can exercise such rights. If you want to receive further information about your rights or to exercise them, contact us by sending an email to privatumas@realco.lt.

REALCO, without unreasonably delaying, but not later than within 1 month from the day of receipt of a request, will provide you with information about actions taken upon receipt of your request regarding exercise of your rights. Depending on complexity of a request and number of received requests, the above-mentioned term may be prolonged for 2 months, in any event we will inform you about prolongation of the term and reasons for that within 1 month from the day of receipt of your request.

14.1. THE RIGHT TO REVOKE THE CONSENT

If you given your expressive consent to your personal data processing, you can revoke it at any time by sending us an email to privatumas@realco.lt.

14.2. ACCESS TO YOUR PERSONAL DATA

We want you to have full understanding how we will use your personal data and prevent any inconveniences. You can contact us at any time and ask if any of your personal data is processed by us. If we store or use your personal data by any mode, you have the right to access it. To do so, send us a written request by email to privatumas@realco.lt, certify your identity; when submitting such request, you are requested to follow the principle of fairness and prudence.

14.3. THE RIGHT TO REQUEST FOR MORE INFORMATION

We hope you understand that it is very difficult to discuss all possible modes of personal data collection and use. We will do our best to provide the most clear and comprehensive information possible and undertake an obligation to update this Privacy policy, once the process of personal data use changes. However, if you have any questions regarding the use of your personal data, we will be happy to answer them or provide additional information that can be disclosed. 14.4. ADDITIONAL RIGHTS

Below, we provide information about your additional rights, which you can exercise following the below-described procedure.

14.4.1. You have the right to request for correction of any inaccuracies in data. In such event, we can request you to confirm corrected information.

14.4.2. You have the right to request us for deletion of your personal data. Please note, that such request can be fulfilled, only if:

14.4.2.1. your personal data is no longer needed for the purposes it was collected for (e.g., we need your personal data to be able to reply to your letters);

14.4.2.2. collection, storage or use of personal data is prohibited by laws;

14.4.2.3. your personal data is not needed for establishment, implementation or defence of a legal claim, e.g., in a legal procedure.

14.4.3. You have the right to request us for restriction or your personal data processing or not processing:

14.4.3.1. for the period needed by us to satisfy ourselves with the accuracy of your personal data, following your claims made regarding accuracy of data;

14.4.3.2. when collection, storage or use of your personal data carried out by us is unlawful, however you decide not to request for data deletion;

14.4.3.3. when your personal data is no longer needed by us, however you need it for establishment, implementation or defence of a legal claim;

14.4.3.4. for the period needed to establish whether we have a more important legal basis for further processing of your personal data, provided you exercised your right to express your objection to personal data processing.

14.4.4. You have a right to transposition of data we received from you with your consent or for the purposes of signing an agreement. If you exercise this right, upon your request, we will transpose a copy of your provided data.

14.4.5. You have the right to disagree with the use of your personal data by us:

14.4.5.1. when we use such data to secure our legitimate interests, but do not have any more important legal basis for further use of your personal data; or

14.4.5.2. at any time, when we use your personal data for sending newsletters or direct marketing purposes. In such event, data will no longer be used for the latter purposes, however it can be used for other lawful purposes.

15. COMPLAINTS

If you believe that your, as a personal data subject’s rights are and/or may be infringed, please contact us immediately by sending your complaint to email address: privatumas@realco.lt. Only once your complaint is received, we undertake an obligation to contact you within a reasonable term and inform you about the course of the complaint investigation, and later about the result.

If you are not satisfied with the investigation results, you can submit a complaint to a supervisory institution – State Data Protection Inspectorate.

16. RESPONSIBILITY

You are responsible to ensure that your provided data is accurate, true and full. In case of any changes in your provided data, you must inform us immediately, by changing appropriate data in the registration form, or if such data is not provided in the registration form, by sending us an email. We will not be held liable for damage caused by false or incomprehensive personal data provided by you or failure to inform us about any changes in it.

17. AMENDMENTS TO THE PRIVACY POLICY

We can update or amend this Privacy policy at any time. Amended or updated Privacy policy will come into effect on the day it is published on our website. You should check it sometimes to make sure you are satisfied with the effective version of the Privacy policy.

Once we update the Privacy policy, we will inform you about amendments we consider to be essential by publishing them on the website. If you log on to the website after such notice was published, you agree with the new requirements specified in the update. ‘Update date’ specified at the bottom of the Privacy policy indicates the date of the last update of the Privacy policy.
